  • Gucci America has quit the International Anti-Counterfeiting Coalition, the second defection since the Washington, D.C.-based group allowed Chinese e-commerce giant Alibaba to become a member in April. Michael Kors walked out of the IACC last month, calling Alibaba "our most dangerous and damaging adversary." The outrage over Alibaba's membership raises fresh questions about how effective Alibaba has been in fighting fakes as it pushes to take its e-commerce juggernaut global. It has also allowed the deep loathing some harbor for one of China's global champions to burst into view. Gucci, along with other Kering Group brands like Balenciaga, is suing Alibaba in New York federal court. They accuse Alibaba of knowingly encouraging and profiting from the sale of counterfeit goods on its e-commerce platforms. Alibaba has dismissed the suit as "wasteful litigation."

International treaty/regulations
The Berne Convention for the Protection of Literary and Artistic Works, usually known as the Berne Convention, is aninternational agreement governingcopyright, which was first accepted inBerne, Switzerland, in 1886. The Berne Convention formally mandated several aspects of modern copyright law; it introduced the concept that a copyright exists the moment a work is "fixed", rather than requiring registration. It also enforces a requirement that countries recognize copyrights held by the citizens of all other signatory countries.
- The Patent Cooperation Treaty (PCT) is an international patent law treaty, concluded in 1970. It provides a unified procedure for filing patent applications to protect inventions in each of its contracting states. A patent application filed under the PCT is called an international application, or PCT application.

- The WIPO Performances and Phonograms Treaty (or WPPT) 
  • an international treaty signed by the member states of the World Intellectual Property Organization was adopted inGeneva on December 20, 1996. It came into effect on 20 May 2002. The Digital Millennium Copyright Act is the United States's implementation of the treaty (see WIPO Copyright and Performances and Phonograms Treaties Implementation Act). WPPT was adopted with an objective to develop and maintain the protection of the rights of performers and producers of phonograms in a manner as effective and uniform as possible. This treaty would not disturb the existing obligations that Contracting Parties have to each other under the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done in Rome, October 26, 1961 (Rome Convention). Articles 18 and 19 of the WPPT provide similar obligations for performers and producers of phonograms to contracting states as provided under Articles 11 and 12 of the WCT.

  • The International Copyright Act of 1891 is the first U.S. congressional act that extended limited protection to foreign copyright holders from select nations. Formally known as the "International Copyright Act of 1891", but more commonly referred to as the "Chace Act" after Sen. Jonathan Chace of Rhode IslandThe International Copyright Act of 1891 was created because many people shunned the idea of literary piracy.   • The Stop Online Piracy Act (SOPA) was a controversial United States bill introduced by U.S. Representative Lamar S. Smith (R-TX) to expand the ability of U.S. law enforcement to combat online copyright infringement and online trafficking incounterfeit goods. Provisions included the requesting of court orders to baradvertising networks and payment facilities from conducting business with infringing websites, and web search engines from linking to the websites, and court orders requiring Internet service providers to block access to the websites. The proposed law would have expanded existing criminal laws to include unauthorized streaming of copyrighted content, imposing a maximum penalty of five years in prison.
  •  The PROTECT IP Act (Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act, or PIPA) was a proposed law with the stated goal of giving the US government and copyright holders additional tools to curb access to "rogue websites dedicated to the sale of infringing or counterfeit goods", especially those registered outside the U.S.

  • The European patent with unitary effect (EPUE), more commonly known as the unitary patent, is a new type of European patent in advanced stage of adoption which would be valid in participating member states of the European Union.[notes 1] Unitary effect can be registered for a European patent upon grant, replacing validation of the European patent in the individual countries concerned. The unitary effect means a single renewal fee, a single ownership, a single object of property, a single court (the Unified Patent Court) and uniform protection—which means that revocation as well as infringement proceedings are to be decided for the unitary patent as a whole rather than for each country individually. Licensing is however to remain possible for part of the unitary territory. Formal agreement on the two EU regulations[1][2] that made the unitary patent possible through enhanced cooperation at EU level was reached between the European Council andEuropean Parliament on 17 December 2012. The legality of the two regulations was however challenged by Spain and Italy, who filed in total four actions for annulment, two of which were rejected, and two of which are currently pending before the European Court of Justice.[3] All EU member states except Spain and Croatia participate in the enhanced cooperation. Unitary effect of newly granted European patents can be requested, from the date the related Unified Patent Court Agreement enters into force for the first group of ratifiers,[notes 2] and will extend to those participating member states for which the UPC Agreement had entered into force upon the registration of unitary effect. The negotiations which resulted in the unitary patent can be traced back to various initiatives dating to the 1970s. The Statute of Anne, also known as theCopyright Act 1709 (cited either as 8 Ann. c. 21 or as 8 Ann. c. 19), is an act of theParliament of Great Britain passed in 1710, which was the first statute to provide forcopyright regulated by the government and courts, rather than by private parties. Prior to the statute's enactment in 1710, copying restrictions were authorized by theLicensing of the Press Act 1662. These restrictions were enforced by theStationers' Company, a guild of printers given the exclusive power to print—and the responsibility to censor—literary works. The censorship administered under the Licensing Act led to public protest; as the act had to be renewed at two-year intervals, authors and others sought to prevent its reauthorisation. In 1694, Parliament refused to renew the Licensing Act, ending the Stationers' monopoly and press restrictions. Over the next 10 years the Stationers repeatedly advocated bills to re-authorize the old licensing system, but Parliament declined to enact them. Faced with this failure, the Stationers decided to emphasise the benefits of licensing to authors rather than publishers, and the Stationers succeeded in getting Parliament to consider a new bill. This bill, which after substantial amendments was granted Royal Assent on 5 April 1710, became known as the Statute of Anne due to its passage during the reign of Queen Anne. The new law prescribed a copyright term of 14 years, with a provision for renewal for a similar term, during which only the author and the printers they chose to license their works to could publish the author's creations.[4]Following this, the work's copyright would expire, with the material falling into the public domain. Despite a period of instability known as the Battle of the Booksellers when the initial copyright terms under the Statute began to expire, the Statute of Anne remained in force until the Copyright Act 1842 replaced it. The statute is considered a "watershed event in Anglo-American copyright history ... transforming what had been the publishers' private law copyright into a public law grant".[5]Under the statute, copyright was for the first time vested in authors rather than publishers; it also included provisions for the public interest, such as a legal deposit scheme. The Copyright, Designs and Patents Act 1988 (c 48), also known as the CDPA, is an Act of the Parliament of the United Kingdom that received Royal Assent on 15 November 1988. The Pirate Bay (commonly abbreviatedTPB) is an online index of digital content of mostly entertainment media, founded in 2003, where visitors can search, download and contribute magnet links and torrent files, which facilitate peer-to-peer file sharing among users of the BitTorrentprotocol. In 2009, the website's founders were found guilty in Sweden for assisting in copyright infringement. In some countries, Internet service providers have been ordered to block access to the website. "Interesting Lover") sold with similar packaging and a similar name. A settlement between Ishiya and Yoshimoto Kogyo was reached on February 13, 2013, Yoshimoto Kogyo changed the package design, and sales were restricted to the Kansai region. Other products resembling Shiroi Koibito, "Doara no Koibito" (sold by Nagatoya Co., Ltd.) and "Nijigen no Koibito" (sold by Daito Corporation) among others, are manufactured and sold all over Japan.

  • https://hk.finance.appledaily.com/finance/daily/article/20181015/20522669 標榜「日本血統」的內地零售商名創優品(Miniso)經常與山寨扯上關係,多次捲入侵權風波,但創立僅7年已經迅速在全球擴充,本月初更獲騰訊(700)及高瓴資本注資。名創優品始終不甘於發展單一品牌,本報發現其創辦人旗下的內地公司,前年起在香港註冊護膚品牌及名為「銘斐」的酒類品牌,上月更在內地註冊寵物食品及護理品牌Pure Pooch,似為多線品牌發展做準備。 除了家品、文具等,名創優品近年開拓美容及電子產品配件等市場。本報發現,葉國富旗下的內地公司廣東賽曼投資2016年起在香港註冊多個不同品牌。其中一名為Gentillesse L'esprit nature,商標類別包括護膚品、化妝品及精油。品牌名稱Gentillesse是法文,標誌為一顆樹,與原為英國品牌、現已被南海控股收購的Crabtree & Evelyn有幾分相似。同年,公司註冊簡體字「銘斐」的商標,註冊類別是紅白酒、烈酒、啤酒、礦泉水等,未知銘斐的命名與在大陸極受歡迎的法國拉菲酒莊(Lafite)是否有關。不過,在互聯網上暫時未見上述兩個品牌的宣傳。
  •  標榜是瑞典設計師品牌家品店NOME(諾米家居),早前在將軍澳東港城開張,品牌實由內地人創辦,有網民質疑NOME網站上申報的瑞典辦公室地址是杜撰。品牌捲入爭議,但仍有公司在香港註冊了多個極之相似的商標,背後與名創優品有關。 本報發現,名為廣州人人管理諮詢的公司,今年4月註冊與NOME極之相似商標,唯一的差別是Logo的英文字母「O」上少了一橫,同年7月又以同款字體註冊NOMO、ONME商標。據內地傳媒報道,廣州人人管理諮詢有限公司是葉國富控制的廣東賽曼內地關連公司。

Po Chai Pills were developed by Li Shiu Kei in FoshanGuangdong, in 1896. Following the Chinese Civil War, the Li family fled to Hong Kong and reestablished their company, Li Chung Shing Tong. However, their mainland property was nationalized. As a result, there are now two manufacturers of Po Chai Pills:

      A mutual agreement between both parties has limited Wanglaoji's trademark rights to mainland China, while Li Chung Shing Tong has the rights to use the trademark in the rest of the world. The mainland manufacturer exports them from China as Curing Pills or Bao Ji Pills. On 8 March 2010, sales of the pills from Li Chung Shing Tong have been halted in Singapore as a precaution because traces of phenolphthalein and sibutramine had been detected in batches of the capsule form of the pills, and have been recalled.[1]Phenolphthalein's past use for its laxative properties has been discontinued because of concerns it may be carcinogenic. On 24 March 2010, Hong Kong's Department of Health has recalled both Po Chai Pills Capsule Form and Po Chai Pills Bottle Form from local retail outlets and consumers. On 11 May 2010, a licensed manufacturer in proprietary Chinese medicine, Li Chung Shing Tong (Holdings) Ltd. HK has been given the green light to resume production and marketing of Po Chai Pills Bottle Form.[3] Laboratory tests identified 11 tainted samples, all in Capsule Form, while none of the Bottle Form samples was found to contain the above two western medicines. In connection, the manufacturer has withdrawn the application for registration of Po Chai Pills Capsule Form which has already ceased to be produced since late March. Po Chai Pills in the United States imported by Prince of Peace Enterprises, Inc. are not tainted nor affected by the Hong Kong or Singapore recall. As of July 2009, Po Chai Pills in the United States is imported by Solstice Medicine Company.
